This Privacy Policy explains what information we collect, how we use it, and the rights you have over it, in line with the Protection of Personal Information Act, 2013 ("POPIA").

By using this website or registering as a model with Underdog, you agree to the practices described in this Privacy Policy.

1.1 General Website Visitors

  • Pages visited, time spent on site, and referring URLs

  • Cookies and similar tracking technologies (see Section 6)

If you submit a contact form, sign up for a newsletter, or otherwise reach out to us, we may collect:

  • Name and contact details (email, phone number)

  • Company or brand name (where applicable)

  • The content of your message or enquiry

1.2 Registered Models

If you register as a model on our platform, we collect:

  • Name, contact details, and biographical information you provide

  • Photographs, video, and other images of you

  • Measurements, availability, or other professional details relevant to bookings

  • Any additional information you choose to submit as part of your profile

2. How We Use Your Information

We use the information we collect to:

  • Operate, maintain, and improve our website

  • Respond to enquiries and communicate with prospective clients

  • Send newsletters or marketing communications (only where you've opted in, and you may unsubscribe at any time)

  • Market registered models to Underdog's contracted clients, strictly in accordance with the consent each model provides at registration

  • Meet legal, accounting, or regulatory requirements

We do not sell your personal information to third parties.

3. Model Information: Scope of Use

For models registered on our platform, the following applies in addition to the general terms above:

  • Your profile information and images are used only to market you to Underdog's prospective and contracted clients.

  • Access to your profile is restricted to Underdog's internal team and clients contracted with Underdog. It is not publicly accessible.

  • Underdog will request your separate, explicit permission before using or posting any of your information or images publicly (for example, on social media, in public case studies, or in external marketing materials).

  • This use is governed by the specific consent you provide during registration, which you may withdraw at any time (see Section 7).

4. Legal Basis for Processing

We process personal information on the following bases, as required by POPIA:

  • Consent — for model marketing use, newsletter sign-ups, and any public use of images

  • Legitimate interest — for responding to enquiries and operating our website

  • Legal obligation — where required for tax, accounting, or regulatory compliance

5. Data Retention

We retain personal information only for as long as necessary to fulfil the purposes outlined in this policy, or as required by law. Specifically:

  • Model profiles: retained while you remain active on our roster, and for 12 months after you request removal, to allow for any outstanding contractual matters.

  • General enquiries and contact form submissions: retained for 24 months unless a longer period is required for legal or accounting purposes.

  • Newsletter subscribers: retained until you unsubscribe.

You may request earlier deletion of your information at any time, subject to Section 7 below.

Our website may use cookies and similar technologies to improve functionality and understand how visitors use the site. You can control or disable cookies through your browser settings. Disabling cookies may affect certain features of the website.

  • Withdraw consent at any time (for models: this includes withdrawing consent for marketing use, which will result in your profile being deactivated and removed from client-facing access)

  • Request deletion of your personal information, subject to our legal retention obligations

  • Object to the processing of your personal information in certain circumstances

  • Lodge a complaint with the Information Regulator of South Africa if you believe your information has been mishandled

We take reasonable technical and organisational measures to protect your personal information against loss, unauthorised access, alteration, or disclosure. Access to model profiles and images is restricted to authorised Underdog team members and contracted clients only.

We share model information and images only with clients who are formally contracted with Underdog, and only for the purpose of marketing and booking decisions. We do not share your information with any other third party without your consent, except where required by law.
